Promotional Competition Terms and Conditions
1. Promoter
This promotional competition is promoted and administered by the Cobra Association of South Africa (“the Promoter”).
The Promoter may be contacted via its official website at: www.cobracars.co.za
2. Competition Period
The opening date, closing date and draw date of the competition will be published on the Promoter’s official website and official social media platforms.
The current intended draw date is Friday 30 July 2027, unless otherwise amended by the Promoter in accordance with these Terms and Conditions.
No late, incomplete or invalid entries will be accepted.
3. Nature of Competition
This competition is intended to constitute a lawful free entry promotional competition conducted in accordance with applicable South African law,
including the consumer Protection Act 68 of 2008 where applicable.
No purchase or payment of any kind is required in order to enter or participate.
4. Eligibility
The competition is open only to persons who:
4.1 are permanent residents or citizens of South Africa;
4.2 are 18 years of age or older at the time of entry;
4.3 hold a valid South African driver’s licence at the time of the draw and at the time the Prize is awarded; and
4.4 comply with these Terms and Conditions.
4.5 The following persons may not enter the competition: directors, members, employees, officers, agents or contractors of the Promoter;
4.6 suppliers directly connected to the administration of the competition; and
4.7 immediate family members, spouses, life partners or business associates of the persons referred to above.
5. How to Enter
To obtain one (1) valid entry into the competition, a participant must:
5.1 complete the official online entry form made available by the Promoter;
5.2 provide all information requested by the Promoter accurately and in full; and
5.3 submit the entry during the competition period.
5.4 Entry into the competition is free.
5.5 The Promoter reserves the right to reject incomplete, illegible, misleading, fraudulent, duplicate, automated or technically corrupted entries.
6. Additional Promotional Entry
A participant may qualify for one (1) additional promotional entry by:
6.1 liking and following the official Cobra Association of South Africa Facebook page.
The Promoter reserves the right to verify compliance with this clause and may reject any additional promotional entry that cannot reasonably be verified.
This promotional activity is in no way sponsored, endorsed, administered by, or associated with Meta or Facebook.
7. Entry Restrictions
7.1 Only one (1) standard entry per participant is permitted.
7.2 Only one (1) additional promotional entry may be obtained under clause 6.
7.3 Multiple identities, fictitious profiles, automated submissions, bots, scripts, vote farms, manipulated accounts or similar mechanisms intended to unfairly influence the competition are prohibited.
7.4 The Promoter reserves the right to disqualify any participant reasonably suspected of conduct contemplated in clause 7.3.
8. The Prize
8.1 The prize consists of one (1) Cobra kit-build motor vehicle (“the Prize”).
8.2 The exact make, model, specification, colour, trim, configuration, components and final presentation of the Prize shall be determined solely by the Promoter.
8.3 Images used in advertising and promotional material are for illustrative purposes only and may differ from the final Prize awarded.
9. Prize Conditions
The following conditions apply to the Prize:
9.1 The Prize is awarded voetstoots.
9.2 As the vehicle is a kit-build or replica-style vehicle, no manufacturer warranty applies unless specifically confirmed in writing by the Promoter.
9.3 Any component warranties or workmanship warranties, if applicable, will be communicated separately to the winner.
9.4 The Promoter will, at its cost, attend to the registration, licensing and roadworthy certification of the vehicle. The winner is solely responsible for all other costs associated with the Prize, including insurance, transport, transfer of ownership, ongoing maintenance, fuel, taxes and any other compliance requirements relating to the vehicle.
9.5 The Promoter does not guarantee that the vehicle will qualify for insurance approval.
9.6 The winner is solely responsible for obtaining independent tax advice regarding any tax consequences arising from receipt of the Prize.
9.7 The Prize may not be exchanged for cash.
9.8 The winner must collect the Prize, or make mutually acceptable delivery arrangements with the Promoter, within thirty (30) calendar days after being notified that they have won.
9.9 Should the winner fail to collect the Prize or make arrangements within the period referred to above, the Promoter reserves the right to declare the Prize forfeited and select an alternative winner.
10. Winner Selection
10.1 The winner will be selected by means of a random draw conducted by or on behalf of the Promoter.
10.2 The Promoter reserves the right to appoint an independent attorney, accountant, auditor or suitably qualified person to oversee, supervise or verify the draw process.
10.3 The draw outcome shall be final and binding.
10.4 Before the Prize is released, the selected winner must provide satisfactory proof of:
10.4.1 identity;
10.4.2 age;
10.4.3 South African residence; and
10.4.4 possession of a valid South African driver’s license.|
10.5 Failure to provide the required documentation within a reasonable period determined by the Promoter may result in disqualification and the selection of an alternative winner.
11. Winner Notification and Publicity
11.1 The Promoter will endeavor to contact the winner within five (5) business days after the draw using the contact details supplied during entry.
11.2 If the winner cannot be contacted, fails to respond within ten (10) business days, or refuses or fails to comply with these Terms and Conditions, the Prize may be forfeited and an alternative winner may be selected.
11.3 By entering the competition, participants consent to the reasonable use of their name, likeness, photographs, video material, interviews and social media content for purposes connected to the promotion of the competition and the awarding of the Prize, without additional compensation, provided that such use is lawful and reasonable.
12. Disqualification
The Promoter reserves the right to disqualify any entrant who:
12.1 breaches these Terms and Conditions;
12.2 provides false, inaccurate or misleading information;
12.3 attempts to manipulate or unfairly influence the competition process;
12.4 uses automated systems, bots or fraudulent identities;
12.5 fails to meet the eligibility criteria; or
12.6 acts unlawfully or in a manner that may bring the competition or the Promoter into disrepute.
13. Limitation of Liability and Indemnity
13.1 Participation in the competition is entirely at the participant’s own risk.
13.2 The Promoter shall not be liable for any technical malfunction, system failure, network interruption, delayed transmission, lost entry, corrupted data or any circumstance beyond the Promoter’s reasonable control.
13.3 The winner accepts possession and use of the Prize entirely at their own risk.
13.4 To the fullest extent permitted by law, the Promoter shall not be liable for any injury, loss, damage, accident, death, liability, claim or expense arising directly or indirectly from:
13.4.1 participation in the competition;
13.4.2 acceptance of the Prize;
13.4.3 ownership, operation, licensing, storage or use of the vehicle; or
13.4.4 any mechanical, component or registration issue relating to the vehicle after delivery.
14. POPIA and Privacy
14.1 By entering the competition, participants consent to the collection, storage and processing of their personal information for purposes related to administration of the competition.
14.2 Personal information will be processed in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”).
14.3 The Promoter will not sell personal information to third parties.
14.4 Personal information may be shared with service providers or professional advisors involved in administration of the competition where reasonably necessary.
14.5 Personal information collected for purposes of the competition will be retained only for so long as reasonably necessary for administration, audit, legal or regulatory purposes.
14.6 Participants may contact the Promoter via its official website regarding any privacy-related queries or requests.
14.7 Participants may lodge complaints with the Information Regulator of South Africa should they believe their rights under POPIA have been infringed.
15. Amendment, Suspension or Cancellation
15.1 The Promoter reserves the right to amend, suspend or cancel the competition where reasonably necessary due to circumstances beyond its control, including technical failures, force majeure events, legal or regulatory considerations, fraud prevention or operational requirements.
15.2 Any amendments to these Terms and Conditions will be published on the Promoter’s official platforms.
16. Disputes
16.1 Any dispute arising in connection with the competition shall first be referred to the Promoter for internal resolution.
16.2 The Promoter’s decisions relating to the competition shall be final and binding, subject to applicable law.
17. General
17.1 These Terms and Conditions constitute the entire agreement between the participant and the Promoter relating to the competition.
17.2 If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17.3 No failure or delay by the Promoter in enforcing any provision shall constitute a waiver of rights.
17.4 These Terms and Conditions are governed by the laws of the Republic of South Africa.
17.5 Any legal proceedings arising from the competition shall be subject to the jurisdiction of the South African courts.
